1. Acceptance of Terms

By accessing or using Viewtella, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use the service.

2. Eligibility and Account Security

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the service. If you are under 18, you represent that you have permission from a parent or legal guardian.

• You are responsible for all activity under your account and device.
• You must provide accurate information where requested.
• You may not attempt to bypass account or service security controls.

3. Service Description and AI Output

Viewtella identifies products from images and provides product information such as ingredients, nutrition facts, regulatory context, ratings, and purchase links. Results may be generated or summarized using automated systems and third-party sources.

The service is informational only. It is not medical, nutritional, legal, or professional advice. You are solely responsible for decisions you make based on the information provided.

4. Credits, Purchases, and Billing

• Product searches consume credits. Credit usage and limits may vary.
• Credit packs (consumables) are offered through the Apple App Store In-App Purchase system.
• Refunds and chargebacks for App Store purchases are handled by Apple in accordance with Apple’s policies. We cannot issue refunds for App Store transactions.
• All fees are non-refundable except where required by applicable law. Nothing in these Terms limits any mandatory consumer rights available to you under applicable law.
• Credits have no cash value, are non-transferable, and may be forfeited if your account is suspended for abuse or violation of these Terms.
• Prices, available offers, and credit amounts may change at any time without prior notice, except as required by law.

4.1 Apple App Store Terms

If you download the app from the Apple App Store, the following also applies:

• These Terms are an agreement between you and Viewtella, not Apple. Apple is not a party to these Terms.
• Apple has no obligation to provide maintenance or support services for the app.
• To the fullest extent permitted by law, Apple is not responsible for any claims by you or any third party relating to the app or your possession and/or use of the app.
• Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as a third-party beneficiary.

5. Your Content and License

You retain ownership of the images, feedback, and other content you submit. By submitting content, you grant Viewtella a worldwide, non-exclusive, royalty-free license to host, store, process, reproduce, modify, and display that content solely to operate, secure, and improve the service.

You represent that you have the rights and permissions necessary to submit your content and that it does not violate any law or third-party rights.

6. Acceptable Use

You agree not to:

• Use the service for unlawful, harmful, or deceptive purposes.
• Upload content that infringes intellectual property, privacy, or publicity rights.
• Upload sensitive personal data (such as financial, medical, or password information) into the service.
• Reverse engineer, scrape, probe, or attempt to extract proprietary models, data, or source code.
• Use bots or automation to access the service without permission.
• Interfere with, disable, or bypass security or usage limits.

7. Third-Party Services and Links

The service may reference or link to third-party websites, ratings, and retailers. Those services are independent and governed by their own terms and policies. We do not control or endorse third-party content and are not responsible for their availability, accuracy, or practices.

8. Service Availability, Changes, and Enforcement

• We may modify, suspend, or discontinue any part of the service at any time.
• We may impose limits on usage, storage, or features to protect the service.
• We may review activity to detect abuse, fraud, or violations of these Terms.

9. Intellectual Property

All rights, title, and interest in the service, including software, design, and branding, are owned by Viewtella or its licensors. You receive a limited, non-exclusive, non-transferable, revocable license to use the service for personal purposes, subject to these Terms.

10. Feedback

If you provide suggestions or feedback, you grant us a perpetual, irrevocable, worldwide license to use it without restriction or compensation.

11. Privacy

Our data practices are described in the Privacy Policy. By using the service, you consent to those practices.

By submitting images or other content through the service, you authorize us to process that content and to share it with third-party AI processing providers as described in our Privacy Policy.

12. Disclaimers

The service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.

AI-generated outputs and web-sourced summaries can be incomplete, outdated, or incorrect. You must independently verify critical information, including allergens, ingredients, safety instructions, or regulatory status.

You must not rely on the service for medical, emergency, or other health- or safety-critical decisions. Always seek advice from qualified professionals for such decisions.

13. Limitation of Liability

To the maximum extent permitted by law, Viewtella and its affiliates are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business interruption arising from your use of the service.

Our total liability for any claim relating to the service will not exceed the amounts you paid to Viewtella in the 12 months prior to the event giving rise to the claim, or USD 50, whichever is greater.

14. Indemnification

You agree to defend, indemnify, and hold harmless Viewtella, its affiliates, and its personnel from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the service, your content, or your violation of these Terms.

15. Suspension and Termination

We may suspend or terminate access if we reasonably believe you violated these Terms, created legal risk, or threatened the security or integrity of the service. You may stop using the service at any time.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the jurisdiction in which Viewtella is established, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction and venue of the courts located in our principal place of business.

To the fullest extent permitted by law, you waive any right to participate in a class action or jury trial related to disputes arising from these Terms.

17. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice through the app or website. Continued use after updates constitutes acceptance of the revised Terms.
